Introduction

This contractual document will govern the General Terms and Conditions for contracting services (hereinafter, “Terms”) through the website www.escaperoomarcadia.com/, owned by Mari Paz Robles Hernández under the commercial brand Arcadia Escape Room, hereinafter referred to as the PROVIDER, whose contact information is also listed in the Legal Notice on this website.

These Terms will remain published on the website for the USER to reproduce and save as confirmation of the contract and may be modified at any time by the PROVIDER. It is the USER’s responsibility to read them periodically, as the applicable Terms will be those in force at the time of placing orders.

Contracts will not be subject to any formality except in cases expressly indicated in the Civil and Commercial Codes and in this or other special laws.

By accepting this document, the USER:

  • Has read, understands, and comprehends the content herein.
  • Is a person with sufficient capacity to contract.
  • Assumes all the obligations set forth herein.

These conditions will have an indefinite period of validity and will apply to all contracts made through the PROVIDER’s website.

The PROVIDER informs that the business is responsible and knowledgeable of current legislation and reserves the right to unilaterally modify the conditions without affecting the terms and conditions that were implemented prior to the modification.

Identity of the Contracting Parties

On one hand, the PROVIDER of the services contracted by the USER is Mari Paz Robles Hernández, with primary address at 8 Squirrel Street – 41010 Sevilla, NIF 30253736L, with customer service phone number 661 61 38 48 and user support email info@escaperoomarcadia.com.

On the other hand, the USER, registered on the website with a username and password, for which they are fully responsible for use and custody, and is responsible for the accuracy of the personal data provided to the PROVIDER.

Purpose of the Contract

This contract aims to regulate the contractual relationship of sale arising between the PROVIDER and the USER at the moment the USER accepts during the online contracting process the corresponding checkbox.

The contractual sale relationship involves the delivery, in exchange for a specific and publicly displayed price through the website, of a particular service.

Correction of Data

When the USER identifies errors in the data published on the website or in the documents generated by the contractual relationship, they can notify info@escaperoomarcadia.com so that Arcadia Escape Room can correct them as soon as possible.

The USER can keep their data updated by accessing their user account.

Reservation Procedure

To make a reservation on this website, the USER must voluntarily provide the personal data required, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27, 2016 (GDPR), regarding the protection of natural persons concerning the processing of personal data and the free movement of such data, and Organic Law 3/2018, of December 5 (LOPDGDD), regarding the protection of personal data and detailed in the Legal Notice and Privacy Policy of this website.

The USER will use a valid payment method in their name to make the reservation.

According to Article 27 of Law 34/2002, on Services of the Information Society and Electronic Commerce (LSSICE), the contracting procedure will follow these steps:

  1. GENERAL CONTRACTING TERMS

Unless otherwise stipulated in writing, placing an order with the PROVIDER will imply the USER’s acceptance of these legal terms. No stipulation made by the USER may differ from those of the PROVIDER unless expressly accepted in advance and in writing by the PROVIDER.

  1. RESERVATIONS AND RESERVATION PROCESS

On this website, a reservation for the services offered by Arcadia Escape Room can be made. At the beginning of the services and reception of the participants, the chosen room and number of participants will be reviewed. At that time, the payment for the offered services will be processed.

On our website, a credit card number is requested as a deposit for the reservation. If you cannot attend your reservation, you must notify us at least 72 hours in advance.

Security Measures

The website uses generally accepted information security techniques in the industry, such as SSL, data entered on a secure page, firewalls, access control procedures, and cryptographic mechanisms, all aimed at preventing unauthorized access to data. To achieve these ends, the USER agrees that the PROVIDER may obtain data for the purpose of authentication of access controls.

The PROVIDER commits to not allowing any transaction that is or may be considered illegal by credit card brands or the acquiring bank, which could potentially damage their goodwill or negatively impact them.

The following activities are prohibited under card brand programs: the sale or offering of a product or service that does not comply with all applicable laws to the Buyer, Issuing Bank, Merchant, or Cardholder.

Failure to Perform the Distance Contract

If, for any reason, the chosen room is unavailable, the USER will be informed of the lack of availability and will be entitled to cancel the reservation or change the room or date.

The service will be considered performed when the USER has started the service.

How to Make a Reservation?

  1. Go to https://www.escaperoomarcadia.com/ and click on the RESERVE tab.
  2. Choose the desired theme.
  3. Select the day and time from the available options.
  4. Enter the reservation details, as well as any other requested information.
  5. Before proceeding with the reservation of the room, you will be asked to accept these general conditions, thus formalizing them.
  6. Next, you will be asked for your credit card number as a deposit for your reservation.
  7. Once the reservation is made, you will receive an email with the summary of the reservation.

  1. RIGHT OF WITHDRAWAL

The USER has a period of fourteen calendar days, starting from the date of receipt of the product or from the conclusion of the sales contract if it is a service provision, to exercise the right of withdrawal, regulated by Article 102 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, hereinafter RDL 1/2007. If the PROVIDER does not comply with the duty of information and documentation regarding the right of withdrawal, the deadline for exercising this right will end twelve months after the expiration of the initial withdrawal period, according to Article 105 of RDL 1/2007.

The right of withdrawal will not apply to contracts referred to and listed in Article 103 of RDL 1/2007, which can be found here.

The USER is informed that according to section L) of Article 103, there will be no right of withdrawal. Therefore, the amount will not be refunded if the USER does not wish to attend their reservation.

Changing a Reservation:

If you cannot attend your reservation, the amount paid will not be refunded, but you may change your reservation date by notifying us at least 72 hours in advance.

To change a reservation, contact info@escaperoomarcadia.com or 661 61 38 48.

If you do not show up for your reservation, the amount indicated in your reservation will be charged to the provided card.

  1. COMPLAINTS AND ONLINE DISPUTE RESOLUTION

Any complaints that the USER deems appropriate will be addressed as soon as possible and can be made at the following contact addresses:

We inform you that you may also request online dispute resolution through the European Online Dispute Resolution Platform (ODR), available at https://ec.europa.eu/consumers/odr/main/?event=main.home2.show.

  1. JURISDICTION AND APPLICABLE LAW

In the event of any discrepancies or disputes arising from the interpretation or application of these Terms, the competent courts and tribunals of Sevilla will be competent.

These Terms are governed by Spanish law.
